Booking Conditions
Your terms and conditions of booking are one of the most important tools of your trade. We recognise the diversity in travel companies’ selling structures so we provide specialist drafting and advice in respect of conditions suitable for:
- standard and ‘dynamic’ packages
- agency and principal bookings
- ‘non-packaged’ single element bookings
We offer 2 services in this respect:
Standard service
We will check and amend your conditions to ensure compliance with applicable legislation and trade body requirements including:
- Package Travel, Package Holidays and Package Tours Regulations 1992
- ABTA Code of Conduct
- ATOL Regulations, Standard Terms and Guidance
- International Conventions and EU Regulations/Directives including those relating to air carrier liability, denied boarding and identity of operating carrier.
- Disability discrimination legislation
Superior Service
This covers everything that the standard service does plus:
We will provide an individual discussion service in relation to all of the above to enable you to assess with us in detail, your requirements for your booking conditions in the light of your commercial practices and business needs, including:
- advice on potentially ‘unfair terms’ in your conditions under Unfair Terms in Consumer Contracts Regulations 2004 and the ways that they can be made more fair;
- advice on potentially unfair and misleading practices as presented by your booking conditions in the light of the Consumer Protection from Unfair Trading Regulations and suggestions as to the ways these can be avoided or corrected.
It also covers a consideration of your privacy policy and your collection of data to assess compliance with the Data Protection Act 1998 and suggestions as to how your policy and procedures can be changed to ensure compliance. |
